Can I play with players in a different region from mine?
Exoprimal initially prioritizes nearby players for matchmaking. Players in other, further regions may be added to the matchmaking pool as time elapses.
For this reason, you may be matched with players in other regions. However, it is not possible to select a certain region to play with.
Can I post gameplay videos or stream gameplay?
Yes, as long as you adhere to the Capcom Video Policy.

How does saving and loading work?
Exoprimal uses an autosave feature. Please do not turn off the power while the save icon is displayed.
How can I play with my friends?
The Buddies feature allows you and up to four friends to form a single group and play together. However, Buddies can only be comprised of your friends on the same platform.

Is add-on content purchased in a region different from my version of Exoprimal compatible with the game?
We cannot guarantee that add-on content will function properly if used with software from a region different from the one in which the add-on content was purchased.
Is Smart Delivery available?
Yes, Smart Delivery is available.
After purchasing Exoprimal, the Xbox One or Xbox Series X|S version of Exoprimal can be installed at no additional cost. The version most suitable for your console will be installed.
Can save data, achievements, and add-on content shared between Xbox One and Xbox Series X|S versions?
Yes. Save data, achievements, and add-on content can be shared between Xbox One and Xbox Series X|S versions through Smart Delivery.
Note: You must be signed into Xbox Live to use Smart Delivery and share save data, achievements, and add-on content. Save data must be stored on Xbox Live servers to be shared between different versions of the game.
Can I copy my save data?
Save data (including game progress) can only be copied to Xbox Live servers. Save data cannot be copied locally.
Save data that is copied can only be used by the profile that created it. The same save data cannot be used by other profiles.
Can I adjust brightness?
Yes. Brightness can be adjusted by navigating to Settings > Video > Display > Brightness.
Can I change my controller configuration and keybinds?
Yes. Navigate to the following screen to change keybinds and configuration.

Does Exoprimal support cross-saving (sharing save data between different hardware)?
Save data (including game progress) is saved to the platform on which you play. Cross-saving is only supported for the following hardware on the platforms listed below.

Can I still earn rewards from the Survival Pass Season 1: Premium Tier if I couldn't obtain them during the season?
Your Survival Pass Level can only be increased during the relevant season, and corresponding rewards can only be obtained by increasing your Survival Pass Level.
Any rewards not earned during a season cannot be obtained until that season's Survival Pass is made available again during the resale period.
Will the Premium Tier of previous Survival Passes be made available for purchase?
The Premium Tier of previous Survival Passes cannot be purchased outside of specific resale periods.
I previously purchased the Survival Pass Season 1: Premium Tier, and the resale period is coming up.
Do I need to purchase the Premium Tier again to be able to obtain the rewards?
If you previously purchased Survival Pass Season 1: Premium Tier, then you will not need to purchase it again. Once the resale period begins, your Survival Pass Level will return to the level you initially achieved and you can continue earning rewards for that season.

I'm playing on an Xbox Series X|S or an Xbox One and multiple Microsoft accounts are signed in. I've purchased some add-on content on one account and want to purchase the same add-on content on another account, but I can't. What should I do?
First, sign out of the account on which you have purchased the add-on content. Then sign into the account for which you wish the purchase the add-on content and try again.
I can't BEGIN MATCHMAKING, Create Lobby or Find Lobby for Dino Survival Custom Match after leaving a Custom Match.
Check to see whether you're currently in a Buddy Session.
If you're in a Buddy Session, leave the group then BEGIN MATCHMAKING for Dino Survival, as well as Create Lobby and Find Lobby for Custom Matches.
* Once a Buddy Session has been initiated, only the session owner can BEGIN MATCHMAKING, as well as Create Lobby and Find Lobby for Dino Survival Custom Matches. However, to do so, all members must be in the Main Menu.

Can I make my own username?
Players cannot make their own username for Exoprimal. The displayed username will differ according to which platform you are playing on.
- When playing with other users on the same platform
Your online ID and Capcom ID Nickname may be displayed simultaneously, and in other cases only one of the two will be displayed.
Users cannot toggle which name is displayed.
- When playing with other users on different platforms
Only your Capcom ID nickname will be displayed.

Yes, achievements are the same for both editions.

1 GRANT OF LICENSE AND LICENSE LIMITATIONS

In case You are a corporation or other form of organization, You may allow your employees and customers visiting Your commercial establishment to use the Game on the intended platform solely within such commercial establishment.
1.2 Limitations. 2 USE OF SERVICE
2.1 You may access and use the Service in connection with playing the Game and in accordance with (i) this EULA (ii) in the event an account service provided by Capcom is required or allowed upon use of the Game, any applicable terms of use or agreement for usage of such account service, and (iii) the applicable terms of service or subscriber agreement with the Third Party Platform. You shall adhere to all laws, rules, and regulations applicable to Your use of the Service, including the Community Code of Online Conduct as set forth in Section 3 below.
2.2 Capcom may ask You to submit certain personal information in order to create an account or ID related to the use of the Service. You agree to provide and maintain true, accurate, complete and current information. If You provide any information that is untrue, inaccurate, incomplete or not current, Capcom has the right to suspend or terminate your account and refuse any and all current or future use of the Service by you.
2.3 You agree that Capcom may modify or temporarily suspend the Service without prior notice. During any such suspension period, You may be unable to access any information You have stored on the Service or Game. Such suspension may occur when Capcom is conducting regular or emergency maintenance on the Service.
3 COMMUNITY CODE OF ONLINE CONDUCT
Your online conduct and interaction with other Game players should be guided by common sense and basic etiquette. You shall also adhere to the rules of conduct as set forth in this Section (collectively referred to as the âCommunity Code of Online Conductâ). You are required to take into consideration community standards and refrain from abusive or deceptive conduct, cheating, hacking, or other misuse of the Service.
The actions that are prohibited include the following :
ă»You may not manipulate or inflate usage of the Service.
ă»You may not take any action, or upload, post, stream, or otherwise transmit any content, language, images or sounds in any forum, communication, public profile, or other publicly viewable areas or in the creation of any user ID that Capcom or its affiliates, in their sole discretion, find offensive, hateful, or vulgar. This includes any content or communication that Capcom or its affiliates deem racially, ethnically, religiously or sexually offensive, libelous, defaming, threatening, bullying or stalking.

ă»You may not upload, post, stream, or otherwise transmit any content that contains any viruses, worms, spyware, time bombs, or other computer programs that may damage, interfere with, or disrupt the Service.

ă»You will not directly or indirectly disable, circumvent, or otherwise interfere with the operation of software designed to prevent or report the use of Cheats.
ă»You acknowledge and agree Capcom may refuse to allow You to participate in certain online play if You use Cheats in connection with the Service or Game.
ă»You acknowledge and agree that Capcom may report your use of Cheats to the Third Party Platform.
Unless otherwise required by law, Capcom is not responsible for monitoring or recording any activity on the Service, including communications, although Capcom reserves the right to do so and You hereby give Capcom Your express consent to monitor and record Your activities and communications.
Suspension and termination for Misconduct. âMisconductâ refers to any content or behaviour that is unlawful, that constitutes a âCheatâ (as defined above), that violates the Community Code of Online Conduct, and/or that otherwise compromises the security, fairness, or integrity of the gaming environment that Capcom seeks to promote.
Misconduct may be detected through various means, including Capcomâs technological or automated detection systems, as well as reports submitted by individuals who believe that certain behaviour or content is prohibited. Such reports may be made using the âReportâ option or by contacting our customer support through the dedicated form available at [https://c.cid.capcom.com/inquiry/exoprimal.html].
In the event of objectively existent Misconduct, Capcom will notify You, provide a description of the Misconduct, and indicate the proposed measure. You will be given a reasonable opportunity to respond through the contact channel specified in the notice.
Afterwards, depending on the severity and recurrence of the breach, Capcom may take one or more of the following measures, which may include without limitation:
(a) issue a warning;
(b) reset, or modify any username, avatar, or password;
(c) reset Your in game progress to a previous state;
(d) restrict Your access to certain features or functionalities (including chat channels and voice chat) on one or more Services;
(e) impose a temporary suspension of Your account for one or more Services (for example, temporarily preventing You from accessing all or part of the Game); or
(f) terminate Your access to the Service in the case of a serious breach or repeated violations.
Any suspension will specify a fixed duration and, where applicable, the conditions for reinstatement. Termination will be proportionate to the severity of the breach.

4 IN-GAME VIRTUAL CURRENCY AND VIRTUAL ITEMS
4.1 In-game virtual currency, consisting of virtual coins, points or similar items, may be (i) purchased from the Third Party Platform using funds from a wallet associated with the Third Party Platform account and in accordance with the terms and conditions imposed by the Third Party Platform (âPaid In-game Currencyâ) or (ii) earned or obtained through the Game (âFree In-Game Currencyâ, together with Paid In-game Currency âIn-Game Currencyâ). When using In-Game Currency, Free In-Game Currency will be used before Paid In-Game Currency is used. In-game virtual items consisting of digital items such as characters and costume, may be (i) acquired using In-Game Currency or (ii) earned or obtained through the Game ((i) and (ii) together, âIn-Game Virtual Itemsâ).
4.2 CAPCOM RESERVES THE RIGHT TO MANAGE, REGULATE, CONTROL, MODIFY OR ELIMINATE IN-GAME CURRENCY OR IN-GAME VIRTUAL ITEMS, INCLUDING THE PRICE THEREOF, AT ITS DISCRETION, AND WILL HAVE NO LIABILITY TO YOU OR ANY THIRD PARTY FOR ANY OF SUCH ACTIONS. YOU HAVE NO RIGHT, TITLE OR INTEREST IN OR TO ANY IN-GAME CURRENCY OR IN-GAME VIRTUAL ITEMS EXCEPT THE FOLLOWING: A LIMITED, PERSONAL, NON-TRANSFERABLE, NON-SUBLICENSABLE, REVOCABLE LICENSE TO USE, SOLELY WITHIN THE GAME, IN-GAME CURRENCY AND IN-GAME VIRTUAL ITEMS THAT YOU HAVE EARNED, PURCHASED OR OTHERWISE OBTAINED IN A MANNER AUTHORIZED UNDER THE EULA.
4.3 YOU AGREE THAT THE TRANSFER OF IN-GAME CURRENCY OR IN-GAME VIRTUAL ITEMS IS PROHIBITED EXCEPT WHERE EXPRESSLY AUTHORIZED IN THE GAME. ALSO, OUTSIDE OF THE GAME, YOU MAY NOT SELL, REDEEM OR OTHERWISE TRANSFER IN-GAME CURRENCY OR IN-GAME VIRTUAL ITEMS TO ANY OTHER USER OF THE GAME, CAPCOM OR ANY OTHER PARTY.
4.4 YOU AGREE THAT ALL SALES OF IN-GAME CURRENCY AND IN-GAME VIRTUAL ITEMS ARE FINAL AND NON-REFUNDABLE, UNLESS CAPCOM OR THE THIRD PARTY PLATFORM IS OBLIGATED BY APPLICABLE LAWS OR DECIDES IN ITS SOLE AND ABSOLUTE DISCRETION TO PROVIDE A REFUND.
If Capcom discontinues all or part of the Game or Service for reasons not attributable to You, Capcom will provide an appropriate remedy in accordance with applicable consumer law (e.g., refund of unused purchased in-game currency based on the average unit price derived from Your prior currency purchases).
Capcom will provide You with reasonable advance notice, namely 90 days, prior to the discontinuation of the Service.
4.5 YOU AGREE THAT WHILE YOU MAY âEARNâ "BUY" OR "PURCHASE" IN-GAME CURRENCY AND IN-GAME VIRTUAL ITEMS, YOU DO NOT LEGALLY "OWN" SUCH IN-GAME CURRENCY OR IN-GAME VIRTUAL ITEMS AND THE AMOUNTS OF SUCH IN-GAME CURRENCY OR IN-GAME VIRTUAL ITEMS DO NOT REFER TO ANY CREDIT BALANCE OF REAL CURRENCY OR ITS EQUIVALENT. ANY IN-GAME CURRENCY BALANCE SHOWN IN YOUR ACCOUNT DOES NOT CONSTITUTE A REAL-WORLD BALANCE OR REFLECT ANY STORED VALUE, BUT INSTEAD CONSTITUTES A MEASUREMENT OF THE EXTENT OF YOUR LIMITED LICENSE. IN-GAME CURRENCY AND IN-GAME VIRTUAL ITEMS ARE USABLE ONLY WITHIN THE GAME OR THE SERVICE, AND HAVE NO VALUE OUTSIDE THE GAME OR SERVICE.
4.6 The paid content that is displayed as a prepaid payment instrument on the page separately titled "Labeling under the Payment Services Act" (including similar labeling) is treated as a prepaid payment instrument in accordance with the Payment Services Act. Content other than such prepaid payment instruments (including Content purchased with such prepaid payment instruments) shall be deemed to have been provided upon acquisition of such content and shall not constitute a prepaid payment instrument.

To meet the withdrawal deadline, it is sufficient for You to send Capcom Your notification indicating that You are exercising Your right of withdrawal before the withdrawal period has expired.
ă»Effects of withdrawal
In the event that You withdraw from the contract, Capcom shall refund all payments received from You (including delivery costs, but excluding any additional costs arising from Your choice of a delivery method other than the cheapest standard delivery method we offer), without undue delay and, in any event, no later than 14 days from the date on which Capcom received notice of Your decision to withdraw. Capcom will make the refund using the same payment method You used for the initial transaction, unless You have expressly agreed otherwise. In any event, You will not incur any fees as a result of such refund.

5 OWNERSHIP
Except for the license rights granted under this EULA, all title, ownership rights and intellectual property rights in and to (i) the Game (including, without limitation, all text, graphics, music or sounds, characters, names, themes, costumes, videos, audio-visual effects and any other elements which are part of the Game, individually or in combination) and any and all copies thereof and (ii) the Service are owned by Capcom. The Game is protected by national and international laws, copyright treaties and conventions and other laws.
6 USER FEEDBACK
By submitting any feedback, impressions, comments, or suggestions relating to the Game ("Feedback"), You acknowledge and agree that: (a) Capcom has no obligation of confidentiality, whether express or implied, with respect to the Feedback; (b) Capcom may use, disclose (or choose not to use or disclose), or exploit the Feedback for any purpose, in any manner and worldwide, without restriction; (c) Capcom may already be developing or considering materials or ideas that are similar or identical to the Feedback; (d) the Feedback automatically becomes the sole property of Capcom, without creating any obligation on the part of Capcom toward You, and You hereby irrevocably transfer and assign, and agree that You will irrevocably transfer and assign, to Capcom all copyrights (including the rights provided in Articles 27 and 28 of the Copyright Act of Japan), patents and any other intellectual property rights in and to the Feedback; and (e) You are not entitled to any compensation or reimbursement of any kind from Capcom for the Feedback or for Capcomâs use of it under any circumstances.
7 COLLECTION OF USER DATA
In order to provide You with a better game experience, Capcom may collect and store data about You in relation to Your use of the Game and Service, Your connection information and/or Your platform. In addition, certain non-personally identifiable, game usage data (such as actual game plays and summary statistics thereof) are recorded, archived, analyzed and used to create user statistics. All rights to such information, data and usage data collected from You hereunder shall belong to Capcom.
8 WARRANTY DISCLAIMER, LIMITATION OF LIABILITY
8.1 USERS NOT RESIDING IN THE EUROPEAN UNION
THIS SECTION 8.1 APPLIES ONLY IF YOU ARE NOT A RESIDENT OF A MEMBER STATE OF THE EUROPEAN UNION (INCLUDING FRANCE).
THE GAME AND SERVICE ARE PROVIDED ON AN âAS ISâ AND âAS AVAILABLEâ BASIS, EXCEPT WHERE PROHIBITED BY APPLICABLE LAW, AND SUBJECT FOR EUROPEAN UNION OR FRANCE RESIDENTS TO SUBSECTIONS 8.2 TO 8.5.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CAPCOM DOES NOT MAKE AND HEREBY DISCLAIMS ALL GUARANTEES, CONDITIONS, AND WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION:
(A) ANY WARRANTY REGARDING THE CONFORMITY, ACCURACY, CURRENTNESS, COMPLETENESS, RELIABILITY OR SECURITY OF THE GAME OR SERVICE;
(B) ANY WARRANTY REGARDING THE SUITABILITY OF THE GAME OR SERVICE FOR A PARTICULAR USE;
(C) ANY IMPLIED WARRANTIES OF TITLE OR NON-INFRINGEMENT;

CAPCOM DOES NOT WARRANT THAT THE GAME OR SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; THAT THE GAME AND SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR THAT THE SERVICE SHALL COMPLY WITH ANY SERVICE LEVEL AGREEMENT.

UNDER THE APPLICABLE LAWS OF YOUR COUNTRY OF RESIDENCE, THE GAME OR SERVICE MUST BE IN CONFORMITY AT THE TIME IT IS SUPPLIED. WHERE THE GAME OR SERVICE IS PROVIDED ON A CONTINUOUS BASIS, IT MUST ALSO BE IN CONFORMITY THROUGHOUT THE DURATION OF THAT PERIOD.
CAPCOM MAY PERIODICALLY PROVIDE UPDATES TO THE GAME TO MAINTAIN CONFORMITY. IN SUCH CASE, CAPCOM WILL NOTIFY YOU OF THE UPDATES WITH A REASONABLE NOTICE PERIOD AND WILL INFORM YOU OF THE CONSEQUENCES OF NOT INSTALLING THE UPDATE WITHIN THE SPECIFIED TIMEFRAME. CAPCOM SHALL NOT BE RESPONSIBLE FOR ANY DEFECT OR LACK OF CONFORMITY ARISING FROM YOUR FAILURE TO INSTALL SUCH AN UPDATE WITHIN THE REQUIRED PERIOD.
IF AN UPDATE IS NOT REQUIRED TO MAINTAIN THE CONFORMITY OF THE GAME, AND SUCH UPDATE WOULD NEGATIVELY AFFECT YOUR ACCESS TO OR USE OF THE GAME, CAPCOM WILL INFORM YOU OF YOUR RIGHT TO REFUSE OR UNINSTALL THE UPDATE. ACCORDINGLY, YOU MAY HAVE THE RIGHT UNDER EU LAW AND THE LAW OF YOUR COUNTRY OF RESIDENCE TO REQUEST:
(i) THAT THE GAME OR SERVICE BE BROUGHT BACK INTO CONFORMITY; OR
(ii) AN APPROPRIATE REFUND AND/OR TERMINATION OF THIS EULA.

IF YOU ARE A RESIDENT OF FRANCE, THE PROVISIONS OF SUBSECTION 8.2 APPLY IN ADDITION TO THE STATUTORY LEGAL GUARANTEE OF CONFORMITY FOR DIGITAL CONTENT AND DIGITAL SERVICES SET OUT IN ARTICLES L.224-25-12 ET SEQ. OF THE FRENCH CONSUMER CODE, UNDER WHICH CAPCOM REMAINS LIABLE FOR ANY LACK OF CONFORMITY OF THE GAME OR SERVICE. THE ABOVE SUBSECTION 8.1 IS NOT APPLICABLE TO YOU.
IN THE EVENT THE GAME OR SERVICE DOES NOT CONFORM TO THE APPLICABLE REQUIREMENTS, YOU MAY REQUEST THAT IT BE BROUGHT INTO CONFORMITY WITHOUT UNDUE DELAY AND FREE OF CHARGE.
ALTERNATIVELY, YOU MAY REQUEST A PRICE REDUCTION OR THE TERMINATION OF THE EULA WHEN:
âą CAPCOM REFUSES TO BRING THE GAME OR SERVICE INTO CONFORMITY;
âą BRINGING THE GAME OR SERVICE INTO CONFORMITY IS UNJUSTIFIABLY DELAYED OR ENTAILS COSTS OR A MAJOR INCONVENIENCE FOR YOU;
âą THE LACK OF CONFORMITY OF THE GAME OR SERVICE PERSISTS DESPITE CAPCOMâS UNSUCCESSFUL ATTEMPT TO BRING IT INTO CONFORMITY.
YOU ARE ALSO ENTITLED TO A PRICE REDUCTION OR TO TERMINATION OF THE CONTRACT WHERE THE LACK OF CONFORMITY IS SO SERIOUS AS TO JUSTIFY AN IMMEDIATE PRICE REDUCTION OR TERMINATION. IN SUCH CASES, YOU ARE NOT REQUIRED TO FIRST REQUEST THAT THE GAME OR SERVICE BE BROUGHT INTO CONFORMITY.
TERMINATION MAY NOT OCCUR WHERE THE LACK OF CONFORMITY IS MINOR. IT IS UP TO CAPCOM TO PROVE THAT THE LACK OF CONFORMITY IS MINOR.
YOU HAVE TWO YEARS FROM THE DATE OF SUPPLY TO EXERCISE YOUR RIGHTS UNDER THE LEGAL GUARANTEE OF CONFORMITY, IN THE EVENT A LACK OF CONFORMITY APPEARS. FOR THE FIRST YEAR FOLLOWING SUPPLY, YOU ONLY NEED TO DEMONSTRATE THAT A LACK OF CONFORMITY EXISTS; YOU ARE NOT REQUIRED TO PROVE THE DATE ON WHICH THE FIRST ISSUE APPEARED.
THE LEGAL GUARANTEE OF CONFORMITY ALSO REQUIRES CAPCOM TO PROVIDE ANY UPDATE NECESSARY TO MAINTAIN THE CONFORMITY OF THE GAME OR SERVICE.
IN ACCORDANCE WITH ARTICLE L. 224-25-14 OF THE FRENCH CONSUMER CODE, YOU MAY NOT INVOKE A LACK OF CONFORMITY RELATING TO SPECIFIC CHARACTERISTICS OF THE GAME OR SERVICE THAT WERE CLEARLY IDENTIFIED AS DEVIATING FROM THE STANDARD CONFORMITY REQUIREMENTS AND WHICH YOU EXPRESSLY AGREED AT THE TIME OF ENTERING INTO THIS EULA.
IN ADDITION, YOU MAY ALSO BENEFIT FROM THE LEGAL GUARANTEE AGAINST HIDDEN DEFECTS PROVIDED FOR UNDER ARTICLES 1641 ET SEQ. OF THE FRENCH CIVIL CODE. IN SUCH CASES, YOU MAY EITHER TERMINATE THE CONTRACT AND RECEIVE A FULL REFUND OF THE PRICE ONCE YOUR ACCESS TO THE GAME OR SERVICE HAS ENDED, OR RETAIN ACCESS AND RECEIVE A PARTIAL REFUND OF THE PRICE.
8.4 THE PRESENT SECTION AND THE LIMITATIONS OF LIABILITY SET THEREIN APPLY ONLY IF YOU ARE NOT A RESIDENT OF A MEMBER STATE OF THE EUROPEAN UNION:
EXCEPT IN CASES OF WILLFUL MISCONDUCT OR NEGLIGENCE BY CAPCOM, CAPCOM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE GAME OR SERVICE, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, REVENUE OR DATA, OR ANY OTHER KIND OF DAMAGE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY SET FORTH IN THIS EULA.
IF CAPCOM IS FOUND TO BE LIABLE TO YOU FOR DAMAGES IN CONNECTION WITH THE GAME OR SERVICE WHICH ARISES OUT OF NEGLIGENCE (EXCLUDING GROSS NEGLIGENCE) BY CAPCOM, CAPCOM SHALL ONLY BE LIABLE FOR DIRECT AND ORDINARY DAMAGES ACTUALLY INCURRED BY YOU, REGARDLESS OF DEFAULT, TORT OR ANY OTHER CAUSE OF ACTION. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF CAPCOM TO YOU EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE GAME.
CERTAIN JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF IMPLIED WARRANTIES OR LIABILITY, IN SUCH CASES, THESE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.
8.5 IF YOU ARE A RESIDENT OF A MEMBER STATE OF THE EUROPEAN UNION:
CAPCOM SHALL NOT BE LIABLE FOR DAMAGES RESULTING FROM EVENTS NOT ATTRIBUTABLE TO CAPCOM, INCLUDING FORCE MAJEURE, THE UNFORESEEABLE ACT OF A THIRD PARTY NOT ACTING ON CAPCOMâS BEHALF, OR FROM YOUR USE OF THE GAME OR SERVICE CONTRARY TO THE DOCUMENTED INSTRUCTIONS, MINIMUM TECHNICAL REQUIREMENTS, OR INTENDED USE CLEARLY COMMUNICATED TO YOU.
CAPCOM SHALL NOT BE RESPONSIBLE FOR ANY DEFECT OR LACK OF CONFORMITY ARISING FROM YOUR FAILURE TO INSTALL ANY UPDATES WITHIN THE REQUIRED PERIOD PROVIDED THAT YOU WERE DULY INFORMED OF THE AVAILABILITY OF THOSE UPDATES AND OF THE CONSEQUENCES OF FAILING TO INSTALL THEM, AND PROVIDED THAT THE NON-INSTALLATION OR INCORRECT INSTALLATION WAS NOT DUE TO DEFICIENCIES IN THE INSTALLATION INSTRUCTIONS SUPPLIED BY CAPCOM.
NOTHING IN THE PRESENT SUBSECTION 8.5 SHALL EXCLUDE OR LIMIT CAPCOMâS LIABILITY WHERE THE DAMAGE RESULTS FROM:
âą CAPCOMâS FAILURE TO PROVIDE THE GAME OR SERVICE AS CONTRACTUALLY AGREED;
âą CAPCOMâS FAILURE TO COMPLY WITH APPLICABLE LAW;
âą A LACK OF CONFORMITY WITHIN THE MEANING OF DIRECTIVE (EU) 2019/770 OR APPLICABLE NATIONAL LAW;
âą ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
9 INDEMNITY
YOU ARE SOLELY RESPONSIBLE FOR ANY DIRECT DAMAGE OR LOSS CAUSED TO CAPCOM AS A RESULT OF YOUR INTENTIONAL OR NEGLIGENT USE OF ALL OR PART OF THE SERVICE IN VIOLATION OF APPLICABLE LAW, THIS EULA OR THE RULES GOVERNING ONLINE CONDUCT SET OUT IN THE COMMUNITY CODE OF ONLINE CONDUCT MENTIONED ABOVE.
YOU HEREBY AGREE TO INDEMNIFY CAPCOM AND ITS AFFILIATES, FOR ANY THIRD-PARTY CLAIM, LIABILITY, DAMAGES AND RELATED COSTS (INCLUDING REASONABLE ATTORNEYSâFEES) THAT ARISE DIRECTLY AND EXCLUSIVELY FROM YOUR INTENTIONAL OR NEGLIGENT BREACH OF THIS EULA, YOUR UNLAWFUL USE OF THE GAME OR SERVICE OR YOUR INTENTIONAL OR NEGLIGENT HARMFUL CONDUCT IN VIOLATION OF THE COMMUNITY CODE OF ONLINE CONDUCT.
CAPCOM MAY, AT ITS OWN EXPENSE, ASSUME CONTROL OF THE DEFENSE AND RESOLUTION OF ANY CLAIM FOR WHICH YOU AGREED TO INDEMNIFY CAPCOM. THE PROVISIONS OF THIS SECTION 9 SHALL REMAIN IN FORCE AFTER TERMINATION OF THIS EULA, TO THE EXTENT PERMITTED BY APPLICABLE LAW.
10 TERM AND TERMINATION
10.1 Term. The EULA is effective upon acceptance by You and terminates when terminated according to the terms of this EULA.
10.2 Termination of EULA. You may terminate this EULA, at any time, for any reason. Capcom may suspend or terminate Your access to the Game or the Service in the event of a serious or repeated violation of applicable law, this EULA or the Community Code of Online Conduct. Except where immediate action is reasonably necessary to protect the security or integrity of the Service or other users, Capcom will provide You with prior notice of the intended measure and, where appropriate, an opportunity to remedy the breach. Upon termination of this EULA, Your license to use the Game and Service shall terminate. If termination is due to Your intentional or negligent breach of this EULA, You may lose access to information and data associated with the Game, including In Game Currency and In Game Virtual Items, to the extent such loss is reasonably necessary and proportionate to the breach. If termination is not attributable to You and is not at Your initiative, Capcom will provide the remedies required under applicable consumer law, as set out in clause 4.4 of this EULA.
11 CHANGES TO EULA
11.1 Users not residing in the European Union.
The present Section 11.1 only applies if You are not a resident of a Member State of the European Union.
Capcom may revise, update, change, modify, add to, supplement, or delete certain terms of this EULA for security, legal, best practice or regulatory reasons. Such changes shall take effect following prior notice (including, without limitation, by posting the revised EULA on Capcomâs website) to You, and after fourteen (14) calendar days, or the number of days set forth by Capcom, have elapsed from such notice.
You can review the most current version of this EULA by clicking on the âEULAâ link located on Capcomâs website. You are responsible for reviewing this EULA periodically for changes. If any future change to this EULA is unacceptable to You or cause You to no longer be in agreement or compliance with this EULA, You may terminate this EULA in accordance with Section 10. Your continued use of the Game following any revision to this EULA constitutes Your acceptance of such changes.
11.2 Users residing in the European Union.
The present Section 11.2 applies only if You are a resident of a Member State of the European Union
The most current version of this EULA will always be available on Capcomâs website, by clicking on the âEULAâ link. Capcom may revise, update, change, modify, add to, supplement, or delete certain terms of this EULA for security reasons, to comply with applicable law and regulatory requirements, or to adapt the EULA to new technical or best-practice standards, provided that such changes do not alter the essential characteristics of the Game or Service, their price, Capcom and Your rights and obligations, or the duration of this EULA, and are not to Your detriment.
Capcom will notify You of any proposed revision in advance by email or other appropriate means. If you do not object to these modifications within four (4) weeks from the date on which they are notified to you, the modifications shall be deemed accepted.
Where a proposed revision concerns any of the elements listed in the second paragraph of the present Section 11.2, You will be required to reaccept the revised EULA through a mechanism made available for that purpose.
If the revision negatively affects your access to or use of the Game, and unless the impact on You is only minor which Capcom should demonstrate, You may terminate this EULA free of charge within a period not exceeding 30 days.
If You object to a proposed revision before it takes effect, Capcom may consider the EULA is terminated by Your initiative in accordance with Section 10.
Any revision shall apply only from its effective date and shall have no retroactive effect, unless retroactive application is required by applicable law.
12 SUPPLEMENTAL CLAUSES FOR TEST
12.1 This section is made a part of the EULA to supplement the clauses of this EULA for those who participate in the test (âTestâ) of the Game.
12.2 During the Test, You are required to cooperate with Capcom including but not limited to reporting Capcom of any defects of the Game or Service (e.g. bugs) and also to report Capcom of any other matter Capcom requests.
12.3 You may not disclose any information you obtain during the Test, including but not limited to the content of the Game or Service, features, and technologies to any third party unless expressly permitted to do so by Capcom.
12.4 Any information provided by You under Section 12.2 shall be treated according to Section 6 of this EULA.
12.5 TO TEST IS INTENDED FOR FINAL TESTING OF THE GAME OR SERVICE IN COURSE OF DEVELOPING TO COMPLETE THE DEVELOPMENT OF THE COMMERCIAL VERSION OF THE GAME. THEREFORE, CONTENTS OR FEATURES OF THE GAME MAY BE LIMITED. CAPCOM MAY, AT ITS SOLE AND ABSOLUTE DISCRETION, CANCEL OR POSTPONE THE TEST, CHANGE THE TERM OF THE TEST, OR CANCEL OR PAUSE YOUR PARTICIPATION IN THE TEST. WARRANTY DISCLAIMER AND LIABILITY LIMITATION SET FORTH IN SECTION 8 SHALL APPLY TO THE TEST. YOU AGREE TO PARTICIPATE IN THE TEST AT YOUR OWN RISK.
12.6 Capcom will not take over Your data stored to Capcomâs server or Your platform during the term of the Test to the commercial version of the Game. You cannot use Your Test data after the Test is over.
13 GENERAL
13.1 Governing Law and Jurisdiction.
a) Asian residents. This EULA shall be governed by and construed in accordance with the laws of Japan. Except as set out below, any dispute arising out of or relating to this EULA may be brought before the Tokyo District Court of Japan, which shall have jurisdiction in the first instance.
b) Consumers residing in the European Union. If You are a consumer residing in a Member State of the European Union, the above choice of law shall not have the result of depriving You of the mandatory consumer protection provisions of the law of Your country of residence. Any dispute arising out of or relating to this EULA may be brought before the competent courts of Your country of residence. Capcom may bring a claim only before the courts of Your country of residence.
c) Consumers residing in France. If you are a resident of France, this EULA shall be governed by and interpreted in accordance with French law, and any dispute arising out of or relating to this EULA may be brought before the competent French courts.

In accordance with Article L.612 1 of the French Consumer Code, You may use the consumer mediation service designated by Capcom, free of charge. The mediator may be contacted only after You have first attempted to resolve the matter directly with Capcom by submitting a written complaint, and within one year from that complaint.

d) Consumers residing in North America. If you reside in North America, this EULA, as well as Your use of the Game, is governed by the laws of the United States and the State of California. Any claim or dispute arising out of or relating to this EULA or Your use of the Game, to the extent not subject to an arbitration agreement, shall be brought exclusively before the federal or state courts located in Los Angeles County, California. You and Capcom expressly agree to submit to the personal jurisdiction of these courts and waive any objection regarding venue.
In any event, nothing in the present Section shall exclude or limit any rights You may have under the mandatory consumer protection laws of Your country of residence.
13.2 Remedies in your residence. You may have the benefits of certain rights or remedies under certain laws of your residence. In addition, certain laws of your residence may not allow the exclusion or limitation on liability or limit available remedies in certain circumstances.
13.3 Class Action Waiver. ANY DISPUTE RESOLUTION PROCEEDINGS, WHETHER IN COURT OR ARBITRATION, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION OR AS A NAMED OR UNNAMED MEMBER IN A CLASS, CONSOLIDATED, REPRESENTATIVE OR PRIVATE ATTORNEY GENERAL ACTION, UNLESS BOTH YOU AND CAPCOM SPECIFICALLY AGREE TO DO SO IN WRITING FOLLOWING INITIATION OF THE JUDICIAL PROCEEDING OR ARBITRATION.
13.4 No Waiver. No failure or delay by either Capcom or You in exercising any right or remedy under this EULA or at law shall constitute a waiver of that right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy. No partial exercise of any such right or remedy shall prevent or restrict the further exercise of that or any other right or remedy. A waiver of any right or remedy shall be effective only if it is made in a written statement signed by Capcom or by You.
13.5 Export Restriction. You agree to comply with all applicable laws and regulations of Japan and any other applicable countries (including your residence). You agree not to export, use internet transmission or any other means to export the Game to any country restricted and under embargo by the Japanese Government based on âForeign Exchange and Foreign Trade Actâ and âExport Trade Control Orderâ.
13.6 Severance.If any court of competent jurisdiction or competent authority finds that any provision of this EULA is invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of this EULA shall not be affected. If any invalid, unenforceable or illegal provision of this EULA would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable to reflect Capcomâs initial intentions.
13.7 Relationship of the Parties.The relationship of You and Capcom established by this EULA is solely that of independent contractors. Neither party is, nor will be deemed to be, an agent or legal representative of the other party for any purpose. Neither party is granted any right or authority to assume or to create any obligation or responsibility, express or implied, on behalf of or in the name of the other party.
13.8 Entire Agreement. This EULA and the Privacy Policy shall constitute and contain the entire and exclusive understanding and agreement of You and Capcom with respect to the subject matter hereof and cancels and supersedes any and all prior and contemporaneous understandings and agreements, whether oral or written, between the parties with respect to the subject matter hereof.
13.9 Any communication from the customer to Capcom regarding the Game or Service shall be made by sending an inquiry form to be placed at the appropriate location within the Game or Service or on the website operated by Capcom, or by any other method designated by Capcom.
13.10 The original of this EULA is in English. Any and all translated versions are provided only for reference purposes. You agree to waive any rights under the law of the country/region of your residence to have this EULA executed, written or construed by any other language.
